1. Scope of Application

These Terms and Conditions (hereinafter referred to as “these Terms”) apply to all users (hereinafter referred to as “Users”) who access or use the services of our company (hereinafter referred to as “the Company”) via the Company’s website (hereinafter referred to as “the Website”) or Facebook page. The Company’s services are mainly for B2C individual consumers, with divers as the core customer group. The services include overseas self-guided diving bookings and diving instruction services provided by the Company’s instructors (hereinafter referred to as “the Services”). By using the Website and the Services, Users agree to comply with these Terms; if you do not agree, please do not use the Website or the Services.

2. User Responsibilities

2.1 Users warrant that the personal information provided (such as contact details, diving experience, etc.) is true, accurate and complete. If there are any changes, Users must update the information immediately to avoid additional costs or negative impacts on service experience due to incorrect information.
2.2 Users shall properly keep the login information of their Website accounts (if any). The Company shall not be liable for any account security issues or losses caused by improper personal custody.
2.3 When using overseas diving services, Users must comply with local laws, diving rules and instructor guidance. If Users have special health conditions (such as heart disease, hypertension, etc.), they must inform the Company in advance. The Company shall not be liable for any accidents caused by concealing health issues.

3. Service Terms

3.1 Overseas Self-Guided Diving: Users may choose their own itinerary, but must confirm the opening hours of dive sites, local accommodation and transportation arrangements with the Company in advance. The Company is only responsible for assisting with bookings. In case of itinerary adjustments due to force majeure such as local weather or policy changes, the Company will notify Users in a timely manner and assist with coordination, but shall not be liable for direct losses.
3.2 Diving Instruction Services: Instruction is provided by the Company’s certified diving instructors. Users must complete pre-class preparations (such as equipment inspection, theoretical learning) as required by the instructors, and follow the instructors’ guidance during the training. The Company shall not bear primary liability for safety issues caused by Users’ failure to follow instructions.
3.3 Service Booking and Cancellation: Users are required to pay a deposit (the specific amount is subject to the order) when booking the Services. If cancellation is required, Users must notify the Company 7 days in advance to receive a 50% refund of the deposit; if cancellation is made within 3 days in advance, the deposit will not be refunded. If the Company is unable to provide the Services due to its own reasons, the full deposit will be refunded and a compensation of 10% of the order amount will be provided.

4. Intellectual Property Rights

All content on the Website and Facebook page (including text, images, dive site introductions, service information, etc.) is the property of DIVEHOLIC (HK) LIMITED. Without the Company’s written consent, Users shall not copy, reprint, modify or use the content for commercial purposes, otherwise they shall bear legal liability.

5. Disclaimer

5.1 The information on the Website and Facebook page is for reference only. The Company will make every effort to ensure the accuracy of the information, but does not guarantee that the content is error-free. For any information updates, the latest notice from the Company shall prevail.
5.2 The Company shall not be liable for Users’ inability to access the Website or use the Services due to factors beyond the Company’s control, such as network failures, hacker attacks, or policy adjustments of third-party platforms (e.g., Facebook), but will make every effort to assist in resolving the issue.
5.3 Overseas diving services involve outdoor activities and carry certain risks. The Company will provide necessary safety guidance and insurance recommendations, but Users must purchase overseas travel insurance and diving-specific insurance on their own. The Company shall not be liable for losses caused by failure to purchase insurance.

6. Changes to Terms and Dispute Resolution

6.1 The Company reserves the right to modify these Terms according to business adjustments. Modified Terms will be published on the Website and Facebook page. If Users do not raise objections within 7 days after publication, it shall be deemed that Users agree to the new Terms.
6.2 Any disputes between Users and the Company regarding the Services or these Terms shall first be resolved through friendly negotiation. If negotiation fails, the dispute may be submitted to the Hong Kong International Arbitration Centre (HKIAC) for arbitration in accordance with its arbitration rules. The arbitration award shall be binding on both parties.
